These Terms of Service (“Terms”) govern your use of the website and client portal operated by Optimal Power Solutions, LLC (“OPS,” “we,” “us,” or “our”) and your engagement of our services. By accessing our website, requesting service, or using our portal, you agree to these Terms. If you do not agree, do not use the website or services.
1. Our Services
We provide licensed and insured electrical contracting services in Jacksonville & Northeast Florida. Information on this website is for general informational purposes and does not constitute a binding offer, quote, or guarantee of availability, pricing, or results. The specific scope, price, and terms of any work are governed by the written estimate and contract you approve.
2. Service Requests & Estimates
Submitting a service request does not create a contract or obligate either party. We may follow up to gather details, schedule a consultation, and prepare an estimate. Estimates are valid only as stated and may be subject to change based on site conditions, inspection, code requirements, materials, or scope changes discovered during the work.
3. Accounts & Portal Use
Client portal access is provided on an invitation basis. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us promptly of any unauthorized use. You agree to provide accurate information and to use the portal and website only for lawful purposes.
4. Contracts, Pricing & Payment
All work is performed under a written agreement between you and OPS. Pricing, deposits, progress payments, and payment schedules are as set out in your approved estimate and contract. Unless your contract states otherwise, invoices are due on the terms specified in that contract, and late or unpaid amounts may be subject to late charges and collection or lien remedies as permitted by Florida law.
5. Electronic Signatures & Communications
You agree that electronic signatures, contracts, and records have the same legal effect as handwritten signatures and paper records under the federal ESIGN Act and the Florida Uniform Electronic Transaction Act. You consent to receive communications, agreements, and notices electronically in connection with our services. When you electronically sign a document, we record evidence of that signature as described in our Privacy Policy.
6. Customer Responsibilities
You agree to provide safe and timely access to the work site, accurate information about the property and the requested work, and any approvals or information needed to perform the work. You are responsible for disclosing known hazards and for obtaining any permissions required from owners, associations, or other parties where applicable.
7. Warranties
Any workmanship warranty we provide is as described in your written service agreement. Except as expressly stated in that agreement or required by law, our services and this website are provided “as is,” and we disclaim all other warranties, express or implied, including implied warranties of merchantability and fitness for a particular purpose. Manufacturer warranties for materials and equipment, where applicable, are provided by the manufacturer.
8. Limitation of Liability
To the fullest extent permitted by law, Optimal Power Solutions, LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or revenues, arising out of or relating to your use of the website. Nothing in these Terms limits any liability that cannot be limited under applicable law. Liability arising from electrical work we perform is governed by your service agreement and applicable law.
9. Intellectual Property
The website content, branding, logos, and materials are owned by Optimal Power Solutions, LLC or its licensors and are protected by applicable law. You may not copy, reproduce, or use them without our prior written permission.
10. Governing Law
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. You agree that the state and federal courts located in Florida will have exclusive jurisdiction over any dispute arising out of or relating to these Terms or your use of the website, to the extent not otherwise governed by a dispute-resolution provision in your service agreement.
11. Changes to These Terms
We may update these Terms from time to time. When we do, we will update the “Last updated” date above. Your continued use of the website or services after a change constitutes acceptance of the updated Terms.
